ITD schedules contested case hearing for Imperial Oil/ExxonMobil U.S. 12 shipments
BOISE - The Idaho Transportation Department will hold a contested case hearing April 25 on a proposal to allow Imperial Oil/ExxonMobil to ship oversized equipment on U.S. 12.
Retired State Court District Judge Duff McKee will preside as the hearing officer.
The hearing will allow opponents of Imperial Oil/ExxonMobil's plan to ship oversized loads on U.S. 12 from Lewiston to the Montana state line to present evidence and testimony. The department uses hearing officers to settle a variety of administrative claims ranging from drivers license suspensions and bidding, to construction and highway access claims.
Idaho Transportation Department Director Brian W. Ness initially appointed Boise attorney Merlyn Clark as the hearing officer in February. Those opposed to the shipments objected to Clark's appointment. Both sides agreed to the appointment of McKee.
McKee is a retired state court district judge with 45 years of experience in the law. Although he continues to serve part time as a senior judge, McKee is now in private practice offering dispute resolution services.
The hearing will be held in Boise. No location or time has been set.
