Legislature tackles transportation-related bills

In addition to approving ITD’s Fiscal Year 2009 budget appropriation, the Legislature also considered a number of other bills related to transportation.

The Idaho House and Senate ratified concurrent resolution SCR125 and sent to Gov. Otter for his signature fuel tax agreements that had been negotiated with three Idaho tribes: The Coeur d’Alene, Nez Perce and Shoshone-Bannock. The agreements govern the taxing of fuel sold on reservations.

Legislators also approved a bill that enables ITD to require semi-trucks to use tire chains when conditions warrant on three mountain passes in Idaho. The law applies to Fourth of July and Lookout passes on Interstate 90 in northern Idaho and on Lolo Pass on U.S. 12 between Lewiston and Missoula, Mont. Oregon, Washington and Montana have similar mandatory chain-up laws for semi-trucks.

The law became effective April 1.

ITD-sponsored bills:

H356, Driver Services Efficiency – Amends existing law to revise provisions relating to motorcycle endorsements on driver’s licenses, to delete provisions relating to the retention and return of surrendered driver’s licenses, provides for applications for duplicate driver’s licenses, and authorizes ITD to collect certain fees for reinstatement of drivers licenses after revocation or disqualification. (Passed into law, effective July 1)

H364, Motor Vehicles - Salvage Certificates – Amends existing law to provide for electronic files in regard to salvage certificates of ownership; to revise provisions relating to salvage vehicles; to provide for notations of theft recovery on title records; to provide for branded certificates of title for certain vehicles; to delete inspection provisions, provisions relating to branded certificates of title for reconstructed vehicles and repaired vehicles and provisions relating to branded decals; and to provide for branded certificates of title relating to rebuilt salvage vehicles. (Passed into law, effective July 1)

H365, Motor Vehicle Safety Standards – Amends existing law to require compliance with federal motor vehicle safety standards for certain vehicles subject to registration; to prohibit registration and operation of certain vehicles on public highways of the state; to provide an exemption from titling requirements; to revise dealer licensing provisions; and to revise dealer license bond provisions. (Passed into law, effective July 1)

H366, Driver’s License Expiration Date – Amends existing law to prohibit the issuance of a driver's license, instruction permit, privilege or right to drive to persons not lawfully present in the United States; to require verification of the social security number by the Social Security Administration for an applicant for a driver's license, instruction permit, restricted school attendance driving permit and identification card; and to provide for the expiration dates and fees of a driver's license and identification card issued to a person who is not a citizen or permanent legal resident of the United States. (Passed into law, effective July 1)

S1306, Counties Retain Liability Form Fee – Amends existing law relating to the Idaho Transportation Department to provide for the retention and deposit of the release from liability statement fees by counties. (Passed into law, effective July 1)

S1307, Driver’s License Suspension Procedures – Amends existing law to clarify provisions relating to certain judicial suspensions of driver's licenses. (Passed into law, effective July 1)

H429, Motor Vehicles Insurance – Amends existing law relating to motorist insurance to remove reference to certain liabilities arising out of the ownership, maintenance or use of a motor vehicle; to provide coverage for underinsured motor vehicles in an owner's or operator's policy; to provide for rejection of underinsured motorist coverage; to provide for rejection of uninsured and underinsured motorist coverage in an electronic record in a replacement policy and in a policy issued by an affiliate insurer; to require that, after a time certain, a named insured be provided with an approved statement containing certain explanations; to define a term; and to provide for application. (Passed into law, effective Jan. 1, 2009)

H440, Truck campers – Amends existing law relating to truck campers to revise the definition of "dealer"; to revise the definition of "truck camper"; to require certain truck campers to be titled; to provide for optional titling of truck campers acquired before January 1, 2009; to revise dealer licensing provisions; and to revise dealer license bond provisions. (Passed into law, effective Jan. 1, 2009)

H483, Idaho Transportation Department – Amends existing law to provide that any person owning real property contiguous with surplus real property for sale by the Idaho Transportation Department shall be notified and have first option to purchase the surplus real property. (Passed into law, effective July 1)

S1361, School Zones Speed Limits – Adds to existing law relating to rules of the road to provide for reduced speed limits in school zones; to require certain information on a school zone sign; and to specify a fixed penalty for exceeding the posted speed limit in a school zone. (Passed into law, effective July 1)

S1379, Tire chains Required – Amends existing law relating to tire equipment restrictions to define a term; to provide the Idaho Transportation Department with the authority to require chains on certain commercial vehicles on certain passes; to require the department to take certain actions when requiring the chains; to provide for chaining requirements; and to provide for exceptions. (Passed into law, effective April 1, 2008)

S1440, Special Olympics License Plate – Adds to existing law to establish the Idaho 2009 Special Olympic World Winter Games special license plate program. (Passed into law, effective March 18, 2008)

S1442, Driver Instruction Permits –Amends existing law to revise the definition of "Class D Driver's Training Instruction Permit" and "Class D Instruction Permit"; to provide an expiration date for certain class D instruction permits; to specify age and other qualifications for obtaining a permit; to delete reference to application for a class D driver's training instruction permit; to provide conditions for issuance and expiration of class D driver's training instruction and class D instruction permits; to revise the fee for all driver's training instruction permits and to revise the distribution of fees; to provide for issuance of temporary permits; to specify a condition under which a class D supervised instruction permit becomes a class D instruction permit and to provide for expiration of such instruction permit; and to clarify the requirements for operating a class D vehicle with a class D supervised instruction permit. (Passed into law, effective July 1)
